State Listings, Inc. respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and describes the privacy choices available to you.

1. Scope  

This Privacy Policy applies to State Listings, Inc. and its brands, including NY State MLS and My State MLS (collectively, "State Listings," "we," "us," or "our"). It applies to NYStateMLS.com, MyStateMLS.com, and other State Listings websites, applications, platforms, communications, and services that link to this Privacy Policy (collectively, the "Services"). This Policy does not govern third-party websites, listing portals, applications, or services that maintain their own privacy policies.

2. Personal Information We Collec

Depending on how you interact with the Services, we may collect: 

- Contact and account information, such as your name, mailing address, email address, telephone number, username, brokerage or company, and professional role.
- Professional information, such as your real-estate license number, licensing jurisdiction, brokerage affiliation, professional profile, and information needed to verify your eligibility to use the Services.
- Identity-verification information. In limited circumstances, we may collect identification documents, photographs, or related information to verify identity, prevent fraud, or confirm professional licensure.
- Listing and property information, including property addresses, descriptions, prices, photographs, videos, documents, listing status, listing contacts, and related information.
- Lead and inquiry information, including information provided when someone requests information about a listing, contacts an agent or broker, begins a membership application, or communicates with us.
- Payment and transaction information. Payments are processed by third-party payment providers. State Listings does not store complete payment-card numbers.
- Communications, including emails, support requests, chats, survey responses, feedback, telephone communications, and text-message consent and communication records.
- Internet, device, and usage information, such as IP address, browser and device information, referring and exit pages, pages viewed, approximate location, cookie identifiers, searches, login history, account activity, and interactions with the Services.
- Marketing and advertising information, such as marketing preferences, advertising interactions, and information used to measure or personalize advertising.
- Other information you provide through forms, promotions, testimonials, forums, or other features of the Services.

Please do not provide confidential or unnecessary personal information through public fields or communications.

3. Sources of Personal Information  

We collect personal information: 
- Directly from you;
- From your brokerage, organization, or another person authorized to provide it;
- Automatically through your use of the Services;
- From public and professional records; and
- From providers that support our Services.

4. How We Use Personal Information  

We may use personal information to: 
- Create, maintain, secure, and administer accounts;
- Provide membership, MLS, listing, syndication, directory, communication, and support services;
- Verify identity, professional licensure, and eligibility;
- Process subscriptions and payments;
- Respond to inquiries and provide customer service;
- Route listing inquiries and facilitate communications among consumers, members, agents, and brokers;
- Publish and distribute listings at the direction of participating brokers;
- Maintain listing history and the accuracy and integrity of MLS records;
- Analyze, operate, secure, and improve the Services;
- Measure advertising and understand the effectiveness of our marketing;
- Send service-related, security, marketing, and membership communications;
- Detect, investigate, and prevent fraud, misuse, security incidents, and violations of our agreements;
- Protect the rights, safety, and property of State Listings, our users, and others;
- Comply with legal, regulatory, contractual, and professional obligations;
- Establish, exercise, or defend legal claims; and
- Complete a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction.  

We do not use identity-verification documents for targeted advertising.

5. Public Listings, Member Profiles, and Syndication  

Certain information submitted through the Services is intended to be viewed by other members or the public. This may include listing information, property photographs, professional profiles, brokerage affiliations, and listing-contact information. Members should not include confidential or unnecessary personal information in public listings, profiles, photographs, remarks, documents, forums, or other public fields.

Participating brokers control whether and where eligible listings are syndicated. At a broker's direction, State Listings may distribute listing information and applicable contact information to real-estate portals, IDX participants, search services, and other listing-distribution destinations. State Listings does not sell consumer leads to brokerages. Information made public or distributed through syndication may be copied, indexed, archived, or retained by search engines and other third parties. Removing information from State Listings may not remove copies independently maintained by those parties.

6. How We Disclose Personal Information  

We may disclose personal information to: 
 - Providers that support hosting, security, analytics, advertising, customer support, communications, payment processing, data storage, identity verification, and other business operations;
- Members, brokerages, agents, consumers, and authorized users when necessary to provide the Services or when you direct us to make the disclosure;
- Listing portals, IDX participants, search services, and other listing-distribution destinations selected by participating brokers;
- Analytics and advertising providers, including Google;- Customer-support and visitor-engagement providers;
- Attorneys, auditors, insurers, accountants, and other professional advisers;
- Government authorities, regulators, courts, or law-enforcement agencies when required or permitted by law; and
- Parties involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.  

We may also disclose information when reasonably necessary to enforce our agreements, investigate fraud or misuse, protect legal rights, respond to an emergency, or protect the safety of any person. We may use and disclose aggregated or deidentified information that cannot reasonably be linked to an individual.

7. Sale, Sharing and Targeted Advertising  

 State Listings does not sell personal information for money and does not sell consumer leads. We use Google Ads and related technologies for advertising, conversion measurement, audience measurement, and remarketing. These services may collect or receive identifiers, device information, approximate location, and website activity. State Listings may also provide certain listings and user information to third-party sites and business partners, and these third parties may contact you directly, including by phone, regarding their own products or services. State Listings does not control and is not responsible for their privacy or security practices. 

Under certain state privacy laws, disclosing information to an advertising provider may be considered a "sale," "sharing," or use for "targeted advertising," even when no money is exchanged. Where required by applicable law, you may opt out of these activities by contacting us at [email protected].  We do not knowingly sell or share personal information belonging to children under 16 for targeted advertising.

8. Cookies and Similar Technologies 

We and our providers use cookies, pixels, tags, local storage, and similar technologies to:
- Operate and secure the Services;
- Remember settings and preferences;
- Analyze website traffic and usage;
- Provide chat and customer support;
- Recognize and understand visitor interactions;
- Measure advertising; and
- Deliver or personalize advertisements.

We use Google Analytics to understand website traffic, usage, and performance. We also use Google Ads for advertising, conversion measurement, and remarketing. On certain pages, visitor-engagement technologies may associate website activity with information you provide through chat or forms. 

You can manage nonessential technologies through our cookie or privacy-preferences tool. You may also adjust your browser settings to block or delete cookies, although this may affect certain features of the Services.  Some browsers transmit a "Do Not Track" signal. Because there is no uniform industry standard for responding to these signals, we do not respond to legacy Do Not Track signals. We recognize legally required opt-out preference signals, such as Global Privacy Control, where applicable.

9. Email Communications 

We may send transactional or relationship communications concerning your account, membership, listings, payments, security, support requests, or changes to the Services. Because these communications are necessary to administer your relationship with us, they may not include a marketing opt-out. We may also send marketing communications. You may unsubscribe from marketing emails by using the unsubscribe link in the message or contacting [email protected]. Opting out of marketing will not stop necessary transactional or service-related communications.

10. Text Messages and Two-Factor Authentication 

We use text messages primarily to provide security and two-factor authentication codes when requested. We may also send follow-up messages to prospective members who have consented to receive text messages from our sales team. Message frequency varies based on your interactions with us. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing a service. Reply STOP to stop marketing text messages or HELP for assistance. 

Opting out of marketing messages will not prevent security, two-factor authentication, or other necessary transactional messages requested by you. We may provide telephone numbers and text-message consent records to communications providers as necessary to deliver messages and maintain consent records. We do not disclose SMS opt-in information or telephone numbers to third parties for their own marketing purposes.

11. Data Retention 

We retain personal information for as long as reasonably necessary to provide the Services, maintain appropriate listing and membership records, comply with legal and contractual obligations, resolve disputes, prevent fraud, and enforce our agreements. Retention periods vary based on the nature and sensitivity of the information, the purposes for which it was collected, and applicable legal requirements. 

Listing history and related MLS records may be retained for an extended period when reasonably necessary to preserve MLS history, support compliance, prevent fraud, resolve disputes, or maintain the integrity of listing and property records. We may retain limited information needed to document a privacy or marketing opt-out. Information distributed publicly or through syndication may remain available through third parties outside our control.

12. Security  

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure. No transmission or storage system is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly if you suspect unauthorized access to your account.

13. Your Privacy Rights 

Depending on where you live and subject to applicable exceptions, you may have the right to: 

- Confirm whether we process your personal information;
- Access personal information we maintain about you;
- Correct inaccurate personal information;
- Request deletion of personal information;
- Obtain a portable copy of certain personal information;
- Opt out of the sale or sharing of personal information;
- Opt out of targeted advertising;
- Limit certain uses or disclosures of sensitive personal information;
- Use an authorized agent to make a request; and
- Appeal our refusal to act on a request.  

We will not unlawfully discriminate against you for exercising an applicable privacy right.

Please describe your request and provide enough information for us to identify the relevant records. We may need to verify your identity before completing a request. Verification information will be used only to process and document the request.An authorized agent may submit a request where permitted by law. We may require proof of the agent's authority and may ask you to verify your identity directly. We generally respond within 45 days, although applicable law may permit an extension. Certain information may be exempt from a request, including information we must retain to comply with law, protect security, complete a transaction, preserve appropriate listing history, exercise legal rights, or protect another person's privacy. To appeal a denied request, email [email protected] with the subject line "Privacy Request Appeal" and explain why you believe the decision should be reconsidered.

14. State Privacy Disclosures  

Residents of certain states may have additional privacy rights under applicable law. State Listings will honor verified requests to the extent required by applicable law. California residents may also request information concerning certain disclosures of personal information for third parties' direct-marketing purposes by contacting [email protected]

15. Children's Privacy  

The Services are not directed to children under 13. Membership is limited to persons legally able to enter into the applicable membership agreement. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact [email protected] so that we can investigate and take appropriate action.

16. International Users 

The Services are operated from the United States. If you access the Services from outside the United States, your information may be processed in the United States or other locations where our providers operate. Privacy laws in those locations may differ from the laws where you live.

17. Third-Party Services

The Services may contain links to third-party websites, portals, applications, and services. State Listings does not control and is not responsible for their privacy or security practices. We encourage you to review the privacy policy of each third party you use.

18. Changes to This Policy 

We may update this Privacy Policy to reflect changes to our practices, technologies, Services, or legal obligations. We will post the updated Policy and revise the "Last Updated" date. If a change materially affects how we use previously collected personal information, we will provide additional notice or obtain consent when required by law.
